New fine up to VND 160 million for exceeding the permissible noise level

Decree No. 45/2022/ND-KP on punishment for administrative offenses in the field of environmental protection comes into force on August 25, 2022.
The article provides for fines ranging from warning to capital punishment in the amount of up to 160 million VND.

Under this new rule, noise equal to or greater than 40 dBA (compared to the standard) will be fined up to VND 160 million.

The chairman of the district in the Central District of Ho Chi Minh City said that according to the national technical regulation on environmental protection, the maximum permissible noise level in common areas (apartment buildings, individual houses), separated or adjacent to each other, hotels, motels, administrative buildings) is 70 dBA (from 6:00 to 21:00) and 55 dBA (from 21:00 to 18:00).

The ordinance details how much noise exceeds the norm, but staff and residents continue to face difficulties due to a lack of noise-measuring instruments, the chairman said.
